We reserve the right to modify, suspend, or discontinue any aspect of the website or product offerings at any time. While we strive to ensure that all information is accurate and up-to-date, occasional errors may occur. We reserve the right to correct any typographical, pricing, or descriptive errors and to cancel or refuse any orders placed based on incorrect information.

2. Products & Ordering

SkemGlade offers a curated selection of Shirts, Pants & Trousers, and Skirts. All products are subject to availability. We make every effort to display product colors, textures, and details as accurately as possible; however, the actual appearance may vary slightly due to monitor settings, lighting conditions, or fabric characteristics.

When you place an order, you are making an offer to purchase the selected products. We reserve the right to accept or decline any order for any reason, including but not limited to product unavailability, errors in pricing, or restrictions imposed by applicable laws. A confirmation email will be sent to the address you provide upon order placement; this does not constitute acceptance of your order. Acceptance occurs when we dispatch the goods and send a shipping confirmation.

3. Limitation of Liability

To the fullest extent permitted by applicable law, SkemGlade, its directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the website, the purchase of products, or these Terms.

Our total aggregate liability to you for any claim arising from or related to your use of the SkemGlade website or the purchase of any product shall not exceed the amount you actually paid for the specific product that gave rise to the claim, or the equivalent of fifty US dollars (USD $50), whichever is greater. This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

SkemGlade is not responsible for any delays or failures in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, labor disputes, transportation disruptions, or technical failures.

All rights not expressly granted in these Terms are expressly reserved by SkemGlade.

You are granted a limited, revocable, and non-exclusive license to access and make personal, non-commercial use of the website. This license does not permit you to download (other than page caching), modify, or resell any portion of the website, or to use any data mining, robots, or similar data gathering and extraction tools without our explicit permission.

5. Refund & Return Policy

We at SkemGlade are committed to your satisfaction. If for any reason you are not entirely satisfied with your purchase, you may request a return or refund in accordance with the terms set forth below.

Return Window: You have 30 calendar days from the date of delivery to request a return. To be eligible for a return, the item must be unused, unworn, unwashed, and in the same condition that you received it. All original tags must be attached, and the product must be returned in its original packaging.

Non-returnable Items: For hygiene reasons, certain items may not be eligible for return unless they arrive damaged or defective. These include items that have been worn, altered, or damaged by the customer. Additionally, final sale items, if any, are non-returnable unless required by applicable law.

Refund Process: Once your return is received and inspected, we will send you an email notification to confirm receipt. We will also notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within 5 to 10 business days, depending on your financial institution's processing times.

Late or Missing Refunds: If you have not received a refund after the stated processing period, please first check your bank account again. Then contact your credit card company or bank, as there is often some processing time before a refund is posted. Shipping Costs for Returns: Shipping costs for returning an item are the responsibility of the customer, except in cases where the product received is defective, damaged, or incorrect. In such cases, we will provide a prepaid return label or reimburse reasonable return shipping costs upon verification.

Exchanges: If you wish to exchange an item for a different size or color, please contact us at [email protected] to check availability. Exchanges are subject to product stock and will be processed after the original item is returned and inspected.

Damaged or Defective Items: If you receive a product that is damaged, defective, or incorrect, please contact us within 7 days of delivery at [email protected] with your order number, a description of the issue, and photographic evidence. We will arrange for a replacement or full refund, including any applicable shipping costs.

6. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or relating to these Terms or your use of the SkemGlade website shall be instituted exclusively in the federal or state courts located in the State of Delaware, and you waive any objection to the venue of such courts.
